I Entice shop regulations

1. These regulations set out the rules for making purchases in the online store run by the Seller (NIP: 691-25-46-045, REGON: 384869826) at www.entice.pl and www.enticeofficial.com

2. The Customer Service Department is available from Monday to Friday from 8:00 to 16:00. You can contact using the email address: entice.store@o2.pl or the contact form located on the store's website in the CONTACT tab.

3. Customers can access these Regulations at any time via the link on the main page of the website www.entice.pl and www.enticeofficial.com 

4. By placing an Order, the Customer declares that he has read the Regulations, in particular the possibility of withdrawing from the contract in accordance with the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended); and accepts its provisions.

5. The Customer declares that he owns the copyrights to the Entice products, photos and texts published as part of his opinions on Entice products. The Customer agrees to the free use of such materials by the Seller, on pages belonging to the Seller, in particular on the websites www.entice.pl, www.enticeofficial.com, blog, Facebook, Instagram, and the newsletter without time and territorial restrictions

6. All products offered in the Entice store are brand new, originally packed, free from physical and legal defects, and have been legally placed on the global market.

II Definitions

Terms used in the regulations:
Buyer
- an adult natural person, legal person or organizational unit without legal personality, purchasing the product from the Seller.
Entice online store
- website at www.entice.pl, through which the Buyer can place an order.
Order
- the Buyer's declaration of intent made through the Store, clearly specifying: the type and quantity of Goods, the form of delivery, payment method, Buyer's data and the place of delivery of goods, aimed at concluding a sales contract.
Delivery
- transport service carried out by the carrier.
Store regulations - these regulations for the provision of Entice store services located at: https://www.enticeofficial.com/page/terms-conditions
Privacy policy - the Store's subpage containing information on the collection and use of personal data.
Products - products presented in the Entice Store
Sales contract - a contract for the sale of Goods within the meaning of the Civil Code concluded between the Seller and the Customer, concluded using the Entice Store
Act on consumer rights - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204, as amended);
Discount codes - a string of characters generated by the Entice Store system, made available to the Customer, enabling them to obtain a fixed rebate (amount or percentage) on the conditions specified by a given promotion, described in detail in the regulations of a given promotion.
Purchase vouchers - a string of characters generated by the Entice Store system, made available to the customer electronically or by post, enabling payment for purchases in the Entice Store with a value specified on a given voucher, on the terms specified by the Entice Store, and provided to the Customer - separate conditions.

III Rules for making purchases

A. General provisions

1. The sales contract is concluded between the customer placing the Order (Customer) and the Seller (Entice Store).

2. Sales within the Entice Store take place in all countries that are included in the shipping table (available HERE).

3. The given prices are gross prices. The price shown next to the product at the time the Order is placed by the Customer is binding on the parties to the transaction. The prices presented in the Entice Store do not include the cost of shipping the Good. This cost is presented to the Customer before accepting the Order.

4. Orders placed through the Entice Store can be placed 24 hours a day, 7 days a week, all year round, except during periods related to technical and maintenance breaks.

5. Entice online store conducts retail sales.

6. All Goods offered in the Entice Store are brand new, originally packed, free from physical and legal defects, and have been legally placed on the Polish market.

7. As part of the technical requirements necessary to cooperate with the ICT system used by the Seller in order to make purchases, the Customer should have an active e-mail account.

8. The condition of placing an Order in the Entice Store by the Customer is to read these Regulations and accept its provisions during the implementation of the Order.

B. Placing Orders

1. The given prices are gross prices. The price shown next to the product at the time the Order is placed by the Customer is binding on the parties to the transaction. The prices presented in the Entice Store do not include the cost of shipping the Good. This cost is presented to the Customer before accepting the Order.

2. Orders are accepted by the Entice Store located at www.entice.pl and www.enticeofficial.com 

3. Orders placed through the Entice Store can be placed 24 hours a day, 7 days a week, all year round, except during periods related to technical and maintenance breaks.

4. Orders are processed within 24-72h. In situations where there are reasons that prevent the order from being completed within the specified time, the Seller shall immediately inform the Customer thereof, stating the estimated time of completion. Of course, in this situation, the customer has the right to withdraw from the order, which results in a refund of regulated payments. 

5. The condition for placing an Order is to fill in the form with all required contact details, including the exact address to which the Goods are to be sent, as well as the telephone number and e-mail address. The data provided must be true and current. 

6. If the data provided is not complete, the Seller will contact the Customer. If contact with the Customer is not possible, the Seller has the right to cancel the Order. 

7. The Customer may place an Order and make a purchase without having to permanently register his data in the Entice Store database or create a permanent account. If a permanent account with data is created, the Customer has the right to inspect their data, correct them and request their removal. 

8. After the Customer has successfully placed the order, he will receive an automatic response from the Store confirming the order by e-mail.

9. The Entice Store reserves the right to refuse an Order if the Customer's personal data is incorrect, the transaction has not been authorized in the electronic payment system or the payment for the Order has not been made within a specified time (7 business days).

C. Payment

1. The Entice Store reserves the right to refuse to process an Order in the event of:

a) incorrect completion of the Order form (lack of necessary data needed to complete the Order)

b) not receiving the payment within 7 business days of placing the Order (in the case of payment in advance)

2. Entice Store will inform the Customer about the refusal to process an Order by sending an e-mail to the e-mail address provided by the Customer in the Order.

3. Payment for the ordered products may occur:

I. For domestic payments:

- by bank transfer (prepayment to the bank account)

- using Shoplo online payment (instant transfer). The entity providing online payment services is Blue Media S.A.

- using electronic PayU payments - fast online transfer

- via electronic PayPal payments - a transfer from a PayPal account

- upon receipt of the Good ("on delivery")

II. For foreign payments:

- using electronic PayU payments - fast online transfer

- via electronic PayPal payments - a transfer from a PayPal account

D. Shipping

1. The order placed on business days will be forwarded for execution on the next business day, after the day on which Entice Store recorded the prepayment or after the day on which the payment method was chosen. Orders placed on non-business days will be forwarded for execution on the first business day following the day on which the Entice Store noted prepayment or after the day on which the cash on delivery method was chosen.

2. When finalizing the Order, the Customer may choose one of the available shipping options:

I. In Poland:
- Poczta Polska
- Paczkomaty InPost
- Kurier InPost
- Paczka w ruchu

II. Abroad:

- Polish Post
- GLS courier

3. Goods are sent to the address indicated on the order form. The Entice Store will inform the Customer immediately of an incorrectly completed order form, which prevents or may delay the shipment.

4. The customer is charged for delivery (shipping) specified in the delivery costs. The customer can read the price list at any time by clicking the DELIVERY COSTS link.

E. Discount codes, promotions, Shopping vouchers

1. All promotions (including discount codes) covering the Entice Store cannot be combined with any other promotions. The customer may use only one promotion, unless the promotion conditions explicitly provide for the possibility of using several promotions together.

2. In the case of Discount Codes, one person may use the received Discount Code only once, unless the possibility of using the Code multiple times has been clearly indicated in its separate regulations.
Gift vouchers can be used to purchase all Entice Store products.

3. The amount available under the Purchase Voucher should be used as part of one Order (including shipping costs, unless the terms of the Purchase Voucher state otherwise.) If the full amount is not used within one Order, the remaining amount left on the voucher will be forfeited and cannot be exchanged for funds cash. The Voucher is valid for one year from the date of purchase.

4. If the value of a given Order is higher than the amount available as part of a Purchase Voucher, the Customer may pay the difference using the payment methods available in the Entice Store. Shopping vouchers cannot be used to pay for other people's Orders.

IV Withdrawals from the contract, returns, exchanges, complaints

A. Withdrawal from the contract


1. The customer who is a consumer and has concluded a distance contract has the right to withdraw from the contract within 14 days, without giving a reason. This deadline is a deadline and counts from the date of delivery of the products

2. The right to withdraw from the contract is not entitled in the cases specified in art. 38 of the Act of 30.05.2014 on Consumer Rights, in particular in a situation where the subject of the contract is a non-fabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individual needs, as well as in the case where the subject of the service is an item delivered in a sealed packaging that cannot be returned after opening due to health protection or hygiene reasons if the packaging was opened after delivery.

3. The consumer is responsible for reducing the value of the item, resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item. 

4. Returned Goods should be returned intact (clean, with a full set of tags, devoid of any odors, in the original packaging, with proof of purchase). The product may not bear any signs of use and may not differ from the state it was received.

5. If these conditions are not met, the product will not be returned. 

6. If you want to return the product for which you paid with a Shopping Voucher, the Consumer will not be entitled to a refund of cash, but will have the right to exchange the product for another, available in the Entice Store, of the same value, or receive a Purchase Voucher, equivalent in value to the previous Voucher purchasing.

7. If the value of the exchanged product is lower than the good for which the exchange is being made, the Consumer is obliged to cover the difference using the payment methods available in the Entice Store.

8. The Entice Store must be informed by the Consumer about withdrawal from the contract.

9. The consumer may declare his intention to withdraw from the contract by e-mail by sending a statement of withdrawal from the contract to the following e-mail address: entice.store@o2.pl with the title "Return". The consumer returning the products is obliged to send the seller a clear-sounding statement of withdrawal from the contract containing: information about withdrawal from the contract together with reference to the above act, order number, date of order, first and last name and address of the consumer.

10. The consumer should immediately send the products to the address of the Seller.

11. The consumer bears the direct cost of returning purchased products.

12. Entice Store does not accept any package COD or Locker parcels sent.

13. The Entice Store will refund payments only after receiving the return of the product.

B. Complaint

1. The complaint should contain: Buyer's first and last name, residential address, attached proof of purchase of the product (receipt, invoice), exact designation of the claimed product, indication of the defect describing the non-compliance of the product with the contract and the date of its occurrence; date of submission and signature of the person submitting the complaint. Such notification should be sent to the following e-mail address: entice.store@o2.pl, with "Complaint" in the title.

2. The Entice Store has 14 days to consider the Complaint.

3. The customer loses the right to lodge a complaint before two months have elapsed since finding non-compliance of the goods with the contract will not notify the store of this fact.

4. As part of the accepted complaint, the Entice Store may repair damaged Goods or, if it is possible, replace them with a new one. If this is not possible, the Customer has the right to a refund - the amount he paid for the Goods is returned to his bank account (exception is the condition of Goods purchased using a Gift Certificate).


C. Exchange


1. The consumer may exchange the Goods for another (this also applies to exchange for a different size) on the appropriate principles set out in point IV A., which refers to the conditions of withdrawal.

2. The shipping costs of exchanged products are covered by the Consumer.

3. If the value of the exchanged product is lower than the good for which the exchange is being made, the Consumer is obliged to cover the difference using the payment methods available in the Entice Store. However, if the value of the exchanged product is higher than the value of the product for which the exchange is being made, the difference is covered by the Entice Store returning it to the Consumer on the terms set out in point IV A.

4. The consumer may declare his wish to exchange the products electronically by sending a statement of withdrawal from the contract to the e-mail address: entice.store@o2.pl with the title "Exchange".

V Protection of personal data

A. Privacy policy


1. The administrator of databases of personal data provided by the customers of the store is the Seller.

2. The Seller undertakes to protect personal data in accordance with the Personal Data Protection Act of August 29, 1997 and the Electronic Services Act of July 18, 2002. The Buyer, by providing his personal data to the Seller when placing the order, consents to their processing by the Seller in order to complete the order. The buyer has the opportunity to view, amend, update and delete his personal data at any time.

3. Detailed rules for collecting, processing and storing personal data used to process orders by the store have been described in the Privacy Policy, which is located at:

VI Final Provisions

1. The Entice Store reserves the right to:
- changes in prices and quantity of products in the Entice Store offer
- withdraw individual products from the Entice Store offer
- conducting and canceling all kinds of promotional campaigns and sales
- changes to the regulations for important technical, legal and / or organizational reasons. The amendment to the regulations becomes effective on the date indicated by the Seller, not less than 7 days from the moment of making the amended regulations available on the Store's website. Orders placed by customers prior to the entry into force of amendments to the regulations are implemented according to the existing provisions of the regulations.

2. The current version of the regulations is always available to the Buyer in the "Regulations" tab at the link: https://www.enticeofficial.com/page/terms-conditions

3. During the execution of the order, the regulations accepted by the Customer when placing the order shall apply.

4. In matters not covered by these regulations, the relevant applicable legal provisions shall apply. The Entice Store also informs the Consumer that contentious issues, if the Consumer so wishes, are resolved through out-of-court mediation proceedings before the Provincial Inspectorates of the Trade Inspection or a trial before an arbitration court at the Provincial Inspectorate of the Trade Inspection. As a last resort, the matter is resolved by a court having local and factual jurisdiction.

5. The Regulations enter into force on 27.07.2018 and apply to orders placed after this date.
